Welcome to gfsqhr.shop.

These Terms of Service ("Terms") govern your access to and use of gfsqhr.shop and your purchase of products from our online store.

The store is operated by:

Hvid Invest ApS
Østergade 51E, 2. tv
5000 Odense C
Denmark

Email: support@gfsqhr.shop
Website: gfsqhr.shop

Throughout these Terms, the terms "we", "us" and "our" refer to Hvid Invest ApS.

By accessing our website, placing an order, or purchasing products from us, you agree to these Terms.

Nothing in these Terms is intended to exclude, restrict, or otherwise affect any mandatory consumer rights available to you under applicable German or European Union law.

1. Scope

These Terms apply to orders placed through gfsqhr.shop and to the contractual relationship between you and Hvid Invest ApS.

If you are purchasing as a consumer, mandatory consumer protection laws remain applicable regardless of any provision of these Terms.

A "consumer" means a natural person who enters into a transaction primarily for purposes that cannot be attributed to their commercial or independent professional activity.

2. Eligibility to Purchase

By placing an order through our website, you confirm that:

  • You are legally capable of entering into a binding contract;

  • The information you provide is accurate and complete;

  • You are authorized to use the payment method selected for your order; and

  • You are purchasing products for lawful purposes.

If you are under the legal age required to enter into a binding contract, you may only use our services with the involvement of a parent or legal guardian where required by applicable law.

3. Product Information

We make reasonable efforts to ensure that product descriptions, specifications, images, availability, and other information displayed on our website are accurate.

However, minor differences may occur due to factors such as:

  • Screen or display settings;

  • Product manufacturing variations;

  • Packaging updates; or

  • Improvements to products that do not materially alter their essential characteristics.

We reserve the right to correct obvious errors or inaccuracies on the website.

Nothing in this section limits your statutory rights where a product is defective, materially different from its description, or otherwise not in conformity with the contract.

4. Prices

The price applicable to an order is the price displayed during the checkout process when the order is submitted, subject to correction of obvious pricing errors where permitted by law.

Where required by applicable law, prices shown to consumers include applicable taxes.

Any additional charges that apply to an order will be disclosed before you submit an order.

We currently offer free standard shipping on eligible orders.

5. Payment

We accept the payment methods displayed during checkout.

Where available, customers may choose Cash on Delivery (COD).

For Cash on Delivery orders, payment is generally due when the shipment is delivered.

You are responsible for ensuring that:

  • The delivery information provided is correct;

  • Someone is available to receive the shipment where necessary; and

  • Payment can be made upon delivery in accordance with the instructions provided by the carrier.

Available payment methods may vary depending on your delivery location.

6. Cash on Delivery Orders

If you select Cash on Delivery, your order may be subject to reasonable verification before shipment.

We may contact you using the contact details provided with your order where reasonably necessary to verify:

  • Your identity;

  • Your delivery address;

  • Your order details; or

  • Your intention to receive and pay for the order.

We reserve the right to decline or cancel a Cash on Delivery order where there is a reasonable indication of fraud, misuse, an invalid delivery address, repeated unjustified refusal of COD deliveries, or other legitimate security concerns.

This does not affect your statutory consumer rights.

7. Order Process

Products displayed on our website generally constitute an invitation for customers to place an order rather than a binding acceptance of an order.

When you submit an order, you make an offer to purchase the selected products.

After your order is submitted, we may send you an electronic acknowledgment confirming that we have received it.

An acknowledgment of receipt does not necessarily constitute acceptance of the order unless expressly stated otherwise.

A contract is concluded when we accept your order, for example by sending an order confirmation, dispatch confirmation, or otherwise clearly accepting the order.

8. Right to Reject or Cancel Orders

We may reject or cancel an order where there is a legitimate reason, including where:

  • A product is unavailable;

  • Incorrect product or pricing information was displayed due to an obvious error;

  • Payment or COD verification cannot be completed;

  • Fraud or unauthorized activity is reasonably suspected;

  • The delivery address is incomplete, invalid, or outside an available delivery area; or

  • We are unable to fulfill the order due to circumstances beyond our reasonable control.

If you have already paid for an order that we cancel, any amount due to you will be refunded using an appropriate payment method.

We will not cancel orders for discriminatory or otherwise unlawful reasons.

9. Shipping and Delivery

We currently provide free standard shipping on eligible orders.

Available delivery locations and any applicable delivery restrictions will be shown on our website or during checkout.

Any delivery dates or delivery periods communicated to you are estimates unless expressly agreed as binding.

We will make reasonable efforts to deliver orders within the communicated period.

Delivery may occasionally be affected by circumstances outside our reasonable control, including:

  • Carrier delays;

  • Customs procedures;

  • Severe weather;

  • Transport disruptions;

  • Natural disasters;

  • Public emergencies; or

  • Other events beyond our reasonable control.

Nothing in this section limits any statutory rights you may have regarding delayed delivery.

10. Delivery Information

You are responsible for providing complete and accurate delivery information.

If you discover an error in your delivery information, please contact us as soon as possible at:

support@gfsqhr.shop

If an order has not yet been dispatched, we will make reasonable efforts to correct the information.

Once an order has entered the shipping process, changes may no longer be possible.

11. Risk and Ownership

For consumer purchases, risk of accidental loss or damage generally passes in accordance with applicable mandatory consumer law.

Where applicable, ownership of the goods passes to you once the applicable purchase price has been paid in full.

For Cash on Delivery orders, this generally means once payment has been completed upon delivery.

12. Statutory Right of Withdrawal

If you are a consumer purchasing online in Germany or another EU country, you generally have a statutory right to withdraw from a distance contract within 14 days without giving a reason, subject to applicable legal exceptions.

For goods, the withdrawal period generally begins when you, or a third party designated by you other than the carrier, receives the goods.

To exercise your right of withdrawal, you must clearly inform us of your decision before the withdrawal period expires.

Please contact:

support@gfsqhr.shop

Further details regarding withdrawals, returns, return costs, and refunds are provided in our Return & Refund Policy.

Nothing in these Terms limits your statutory right of withdrawal.

13. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy and applicable consumer protection law.

Before returning a product, please contact:

support@gfsqhr.shop

If you validly exercise a statutory right of withdrawal, any refund due will be processed in accordance with applicable law.

For Cash on Delivery orders, an eligible refund may need to be made by bank transfer or another appropriate refund method because the original payment was made in cash.

14. Defective or Non-Conforming Products

Products must comply with the applicable contractual and statutory requirements.

If a product is defective, damaged, does not correspond to its description, or otherwise fails to conform to the contract, you may have statutory remedies under applicable consumer law.

Depending on the circumstances and applicable law, remedies may include:

  • Repair;

  • Replacement;

  • Price reduction;

  • Termination of the contract; or

  • Refund.

These statutory rights are separate from and are not limited by any voluntary commercial warranty that may be offered.

Please contact support@gfsqhr.shop if you believe a product is defective or non-conforming.

15. Product Availability

All orders are subject to product availability.

We may limit quantities available for purchase where reasonably necessary, including for stock management, fraud prevention, or fair availability.

If a product becomes unavailable after an order has been placed and we cannot fulfill the order, we will notify you and, where applicable, refund any payment already received for the unavailable product.

16. Promotions and Discount Codes

From time to time, we may offer discounts, promotional codes, or special offers.

Unless otherwise stated:

  • Promotions are subject to availability;

  • Promotional codes may have expiration dates;

  • Only one promotional code may be used per order where specified;

  • Promotions may apply only to selected products or customers; and

  • Promotions may not be exchanged for cash.

Any additional conditions applicable to a promotion will be communicated when the promotion is offered.

Nothing in promotional terms affects mandatory consumer rights.

17. Website Use

You agree not to use our website:

  • For unlawful or fraudulent purposes;

  • To infringe the rights of another person;

  • To transmit malicious software, viruses, or harmful code;

  • To interfere with the security or proper functioning of the website;

  • To attempt unauthorized access to systems, accounts, or data;

  • To collect personal information unlawfully;

  • To impersonate another person;

  • To submit false or misleading information; or

  • In any way that violates applicable law.

We may restrict access to the website where reasonably necessary to protect our customers, systems, or legal rights.

18. Intellectual Property

Unless otherwise stated, the content available through gfsqhr.shop, including text, graphics, layouts, design elements, photographs, and other original content owned by us, is protected by applicable intellectual property laws.

You may use the website for personal and lawful shopping purposes.

You may not reproduce, distribute, commercially exploit, or otherwise use protected content without authorization where such authorization is legally required.

Third-party trademarks, product names, and other intellectual property remain the property of their respective owners.

19. Third-Party Services and Links

Our website may contain links to or integrations with third-party websites and services, including:

  • Payment providers;

  • Delivery companies;

  • Technology providers;

  • Analytics services;

  • Social media services; or

  • Other external services.

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for independent third-party websites or services except to the extent responsibility cannot legally be excluded.

Shopify provides the technical infrastructure that enables us to offer our products and services online.

Your use of certain website functions may therefore involve technology and services provided by Shopify and its service providers.

21. Personal Data

We process personal information in accordance with our Privacy Policy and applicable data protection laws.

For more information about the categories of personal information we collect, the purposes for which we use it, cookies, data sharing, retention, and your privacy rights, please review our Privacy Policy.

22. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms is intended to exclude or restrict liability for:

  • Intentional misconduct;

  • Gross negligence where liability cannot legally be limited;

  • Injury to life, body, or health;

  • Liability under mandatory product liability law; or

  • Other liability that cannot legally be excluded or limited.

To the extent permitted by applicable law, we are not responsible for losses resulting solely from circumstances outside our reasonable control.

For consumers, mandatory statutory liability rights remain unaffected.

23. Force Majeure and Events Beyond Our Control

We will not be responsible for delays or failures in performance caused by circumstances beyond our reasonable control to the extent permitted by applicable law.

Such circumstances may include:

  • Natural disasters;

  • Severe weather;

  • War or civil disturbance;

  • Government restrictions;

  • Strikes or transport disruption;

  • Major telecommunications failures;

  • Carrier interruptions; or

  • Other comparable events outside our reasonable control.

We will make reasonable efforts to minimize the impact of such circumstances.

Your mandatory statutory rights remain unaffected.

24. Changes to These Terms

We may update these Terms from time to time to reflect changes to:

  • Applicable laws or regulations;

  • Our business practices;

  • Website functionality;

  • Payment or delivery services; or

  • Other operational requirements.

The Terms applicable to a purchase are generally those in effect when the relevant order is placed, unless a change is required by mandatory law.

Any updated version will display a revised "Last Updated" date.

25. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law.

The remaining provisions will continue to apply to the extent legally permissible.
